Marshall Olson & Hull Maintains Tier 1 Ranking in Commercial Litigation from U.S. News – Best Lawyers

Marshall Olson & Hull Lawyers Win Appeal in Lawsuit Brought by RC Willey Grandchildren

On August 26, 2016, the Utah Supreme Court entered an opinion in the case of McBroom v. Child, Case No. 20140929, 2016 UT 38, affirming the summary judgment ruling dismissing every claim of the plaintiffs–two grandchildren of Rufus Clark Willey, founder of the R.C. Willey & Son furniture empire–who had alleged that firm client KeyBank National Association had deprived the plaintiffs of their rightful inheritance under the terms of their grandfather’s will. As successfully argued by Stephen Marshall, the claims against KeyBank were barred by an agreement entered into in 1973 and the applicable statute of limitations, and there was no basis for applying any equitable tolling of the statute of limitations.

Marshall Olson & Hull Lawyers Win Appeal in Wrongful Termination, FMLA, ADA Case

On April 1, 2016, the Tenth Circuit Court of Appeals entered an opinion in the case of Nebeker v. National Auto Plaza, No. 15-4035 (10th Cir. 2016), affirming the summary judgment ruling of Senior District Judge Bruce S. Jenkins dismissing a former employee’s claims against the Firm’s client for wrongful termination in violation of public policy, interference with the Family and Medical Leave Act (“FMLA”), and discrimination under the Americans with Disabilities Act (“ADA”).  As argued by Marshall Olson & Hull lawyers Erik Olson and Trevor Lang, the Tenth Circuit followed the standard for showing a termination of employment under the 1938 case of Bodmer v. Police Mutual Aid Association, 78 P.2d 640, 643 (Utah 1938), requiring an unequivocal intent to discharge, and held that the employee had not been terminated under this standard.  Additionally, the Tenth Circuit held that the employee had not been prejudiced by any alleged interference with FMLA rights and received all of the accommodation she had requested under ADA.

 

Marshall Olson & Hull Lawyers Win Multimillion-Dollar Arbitration in Contract Manufacturing Dispute

On March 8, 2016, following a three-day AAA arbitration in Chicago, Illinois, Marshall Olson & Hull attorneys Erik Olson and Trevor Lang obtained for a client an award of approximately $450,000 based on a counterclaim made in a dispute over a contract manufacturing agreement involving the sale of firearms.  The arbitrator denied the claimant’s $3 million claim, concluding that the claimant had breached the agreement and was liable to the Firm’s client.

Marshall Olson & Hull Lawyers Win Appeal in Trade Secrets Case Involving Former Employee of Tech Firm

On August 28, 2015, following extensive briefing and two successive rounds of oral argument by Marshall Olson & Hull lawyer Erik Olson, the Utah Supreme Court entered an opinion in the case of Innosys v. Mercer, 2015 UT 80, 364 P.3d 1013, in favor of the Firm’s client, a Salt Lake City based technology company who had filed suit against a former employee who left her employment without returning emails and other materials containing the employer’s trade secrets.  The trial court had entered summary judgment dismissing the employer’s claims against the former employee and even sanctioned the employer for bringing the claims, concluding among other things that the employer had failed to present evidence of actual harm.  The Utah Supreme Court reversed, holding for the first time in Utah that the misappropriation of trade secrets leads to a presumption of irreparable harm, justifying a claim for injunctive relief.
